If you’ve found the property that is perfect for you, the chances are it’ll be perfect for somebody else as well. In NSW, if the seller accepts your offer there remains no legal relationship between the parties until such time that contracts are formally exchanged. That means the seller is within their right to exchange contracts with another party even if they have accepted your offer. This is known as “gazumping”.
At Same Day Conveyancing, we understand that this is a real threat and for this reason we make it our priority to get you Buyer Ready sooner. We’ll review the contract and provide a same day written report (contract must be received by 12 noon) and, in many instances, a same day exchange is also possible.
If you are selling, we will prepare a draft contract within one business day of receipt of your instructions ensuring that you do not miss out on any potential buyers the agent may have ready to buy your home.
The fees for both of these certificates are set by legislation, as follows:
– $53 for a Section 10.7 Certificates (required for a sale); and
– $85 for a Section 603 Certificates (required for a purchase).
Many practitioners will however charge more as they have an undisclosed “service fee” of approximately $60 incorporated into their reported fee for these certificates.
At Same Day Conveyancing, we order these certificates directly from Council and do not charge you extra for the privilege. Better still, as we order direct we also receive these certificates quicker meaning that we can progress with your contract drafting (for a sale) or preparation of settlement figures (for a purchase) sooner.
Ask your conveyancer the cost of these certificates to check you are not being charged an undisclosed “service fee” for these searches – the chances are you will be.
Yes, at Same Day Conveyancing you will only deal with a Licensed Conveyancer. Many practitioners will simply “oversee” your file or pass you down the chain to a unlicensed junior upon exchange of contracts, but at Same Day Conveyancing you can be assured that you’ll only ever have an experienced Licensed Conveyancer touch your file from start to finish.
Ask your conveyancer how many unlicensed people will work on your file throughout the transaction.
If your conveyancer is unable to answer these three simple questions in the same manner, then perhaps it’s time you used a conveyancer with:
i) an understanding of the market and urgency of the situation;
ii) no hidden “service fees” that merely inflate their price; and
iii) experienced licensed conveyancers that work on every aspect of your transaction.
